These Terms of Service (“Terms”) govern your use of WalkAITalkie (“the app”, “we”, “our”), a macOS application developed by Bernhard Götzendorfer, based in Vienna, Austria. By downloading, installing, or using WalkAITalkie, you agree to be bound by these Terms.
WalkAITalkie grants you a limited, non-exclusive, non-transferable, revocable license to use the application on macOS devices you own or control, subject to these Terms and the applicable Apple macOS Software License Agreement.
WalkAITalkie performs all speech recognition and language processing entirely on your Mac using Apple Silicon. Specifically:
WalkAITalkie is available as a free app with optional Pro features available via a one-time in-app purchase, processed through Apple's App Store.
Under EU consumer protection law (Directive 2011/83/EU, implemented in Austria through the FAGG — Fern- und Auswärtsgeschäfte-Gesetz), you have a 14-day right of withdrawal for distance contracts.
Exception for digital content: For digital content not supplied on a tangible medium, the right of withdrawal expires once performance has begun with your express prior consent and your acknowledgment that you thereby lose your right of withdrawal (FAGG §18 Abs. 1 Z 11). The App Store purchase flow handles this consent process.
If you believe you are entitled to a refund, please contact Apple directly through their App Store refund process, or contact us at office@buchhaltgenie.at.
WalkAITalkie downloads AI models (WhisperKit speech recognition and MLX language models) from Hugging Face when you first configure them in Settings. These are one-time downloads cached locally on your Mac.
You retain full ownership of all content generated through WalkAITalkie, including transcriptions, processed text, and custom dictionary entries. WalkAITalkie does not claim any rights to your content. All content remains on your device under your control.
WalkAITalkie, including its design, code, branding, icons, and documentation, is the intellectual property of Bernhard Götzendorfer and is protected by applicable copyright and intellectual property laws. The WalkAITalkie name and logo may not be used without prior written consent.
WalkAITalkie is provided “as is” and “as available” without warranties of any kind beyond those required by applicable law.
Speech recognition and language processing results depend on audio quality, language, accent, and model selection. We do not guarantee the accuracy of any transcription or text processing output.
EU/Austrian consumer rights: If you are a consumer in the EU/EEA, you benefit from statutory warranty rights under the Verbrauchergewährleistungsgesetz (VGG). These rights cannot be excluded or limited by these Terms. Digital content must conform to the contract, and defects appearing within 12 months of delivery are presumed to have existed at the time of delivery.
To the maximum extent permitted by applicable law, Bernhard Götzendorfer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of WalkAITalkie.
Our total cumulative liability for all claims related to WalkAITalkie shall not exceed the amount you paid for the app in the twelve (12) months preceding the claim.
Mandatory Austrian consumer protection: Under the Konsumentenschutzgesetz (KSchG), liability for personal injury and for damage caused by intent or gross negligence cannot be excluded. These Terms do not limit any rights you have under mandatory consumer protection law.
These Terms are governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict of law provisions.
If you are a consumer in the European Union, you also benefit from mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law. In accordance with the KSchG, consumer disputes shall be handled at the consumer's local court.

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of WalkAITalkie after changes are posted constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with a valid provision that comes closest to the original intent.
